Legal Shutdown: Federal Judge Crushes xAI Request to Block Nudify App Ban

A Minnesota state law targeting explicit image generation tools will go into effect as scheduled after a federal judge rejected an emergency request from Elon Musk xAI. U.S. District Judge Donovan Frank denied the company motion for a temporary restraining order, ruling that xAI waited far too long to challenge the law. The decision keeps Minnesota pioneering consumer protections intact while the full lawsuit moves through the legal system.

The state ban specifically outlaws software applications that use artificial intelligence to strip clothing from images without consent. State lawmakers signed the legislation into law earlier this spring, setting a hard launch date of August 1. However, xAI filed its emergency challenge on July 29, 2026, just three days before the law was set to take effect and nearly three months after state officials finalized the bill.

Judge Frank focused heavily on that late timeline inside his written ruling. He pointed out that waiting three full months to seek emergency relief undermines xAI claims of immediate financial or operational damage. The judge explained that such a long delay in bringing the legal action suggests the company faces no urgent harm, making an emergency restraining order unnecessary.

The court ruling does not dismiss xAI lawsuit entirely. Instead, it allows state authorities to enforce the ban against digital platforms while attorneys fight over the legal details. In its initial court filings, xAI argued that the state law reaches too far, calling it overly broad. The company claimed that state officials could achieve their safety goals using far less restrictive rules that avoid blocking broader software functions.

This legal battle connects directly to public backlash surrounding xAI Grok chatbot on the X platform. Earlier this year, users weaponized Grok tools to generate thousands of non-consensual sexualized images, flooding social feeds with fake media. The viral spread of these explicit pictures triggered state investigations, account suspensions, and intense public criticism across the tech industry.

By letting Minnesota law stand, the court ruling sets a key legal precedent for state regulators trying to reign in predatory digital tools. Lawmakers across multiple states are watching the proceedings closely as they draft similar legislation to protect citizens from AI-generated deepfakes. For now, xAI must comply with Minnesota restrictions or face state penalties while the broader suit continues in court.
