
Pulling the Plug on Big Tech: New York Freezes All Massive AI Data Center Construction
New York just became the very first state in the country to put a sudden stop to the massive data center construction boom. Governor Kathy Hochul signed a sweeping executive order that temporarily blocks the state from handing out any new permits for giant computer warehouse projects.
This sudden freeze targets any planned data center designed to pull 50 megawatts of power or more. The new rules will immediately impact more than a dozen major pipeline projects across the state. Under the executive order, the state Department of Environmental Conservation must stop issuing any building permits that have not already cleared final approval.
While local resource strains helped spark the initial community pushback, the broader public anxiety around rapid artificial intelligence development is driving much of this political shift. A recent Pew Research poll revealed that only 10% of Americans feel excited about how fast AI is entering daily life. Only 23% believe the technology will actually help them do their jobs better, while less than a quarter of the public thinks AI will boost the overall economy. To top it off, less than a third of those surveyed trust the government to regulate the technology in a responsible way.
Governor Hochul made her stance clear during a press conference in Brooklyn, stating that technological progress should never force residents to deal with higher utility bills, drained public water systems, or constant noise pollution. She emphasized that these facilities should only exist in communities that actually want them and stressed that tech firms will never get a free pass from local zoning laws or municipal approvals.
The state plans to lift the building freeze once officials finalize a thorough environmental review process, which state offices expect will take about a year to complete. In the meantime, Hochul’s team is looking into forcing these massive facilities to pay into a dedicated fund to protect and support the local electrical grid. She also wants to cut off the sweet tax breaks that giant hyperscale tech builders usually receive when they move into a new territory.
This executive action matches even tougher legislative proposals traveling through the state capital. Just last month, state lawmakers pushed forward a bill that would pause data center construction for anything over 20 megawatts for a year, while another pending bill proposes a strict three-year ban.
The average data center built over the last few years has stayed under the 100-megawatt mark, but the next generation of facilities under development is ballooning in size to meet the heavy processing demands of modern AI. Analysts at BloombergNEF expect nearly a quarter of all upcoming data centers to cross a massive 500 megawatts in capacity.
While organizations across the country have pushed for national restrictions, New York is the first state to actually put a physical ban into practice. Over 230 advocacy groups called for a nationwide freeze on these facilities last December. Other states have tried to pass similar laws, but governors like Maine’s Janet Mills ultimately vetoed those bills.
Just a few years ago, local towns welcomed data center projects for the construction jobs they created, but public sentiment has soured quickly as these facilities grew massive in scale. They now threaten to strain regional power grids, swallow valuable farmland, and guzzle local water. Polling data shows that two-thirds of respondents worry these sites will drive up their monthly electric bills, and many would actually prefer a massive Amazon warehouse next door over a silent data center.
The new moratorium could set up an immediate battle with federal regulators. Last month, the Federal Energy Regulatory Commission, led by a presidential appointee, ordered grid operators to build fast-track lanes to connect data centers to the power grid as quickly as possible. This federal push runs directly into New York’s new defense wall, setting up a high-stakes clash over who actually controls the local power grid.
